WARNING: If you use equipment from SmartGroup AS (RollerSafe/SmartBrake, hereby referred to as SMART BRAKE), it is your responsibility to learn proper use of the equipment, and you accept all risks, including those of injury, paralysis and death. Our equipment is specially designed for rollerskis, skateboards, sleds, bicycles and wheelchairs, has limitations and must not be used for other purposes. Improper use or misuse increases the risks.

Whenever you use the SMART BRAKE, you risk death or serious injury from loss of control, collisions, and falls. To use SMART BRAKE, you must read and follow all instructions and warnings in the Product Documentation. However, it is your responsibility to practise safe use of the SMART BRAKE products in order to reduce this risk.

WARNING!

Always wear a helmet when using roller skis or bicycle. Use an approved helmet that fits properly with the chin strap in place, and provides protection for the back of your head.

Avoid obstacles and slippery surfaces that could result in a loss of balance or traction and cause a fall.

WARNING!

Pay attention to all warnings and alerts from the SmartBrake products. They indicate unsafe operating conditions. You must learn about and understand the SmartBrake products safety alerts described in the Product Documentation and respond as instructed.

The Product Documentation is intended to help you set up and use your SMART BRAKE products. It provides basic information to get you started quickly. For more detailed information, contact SmartGroup AS.

It is important that you adhere to all safety warnings and cautions that appear throughout the Product Documentation, and that you use good judgment when you use your SMART BRAKE products.

Learning to use your SMART BRAKE products

SmartGroup wants you to be safe and enjoy learning how to use your SMART BRAKE products. Think about how you learned to ride a bike, drive a car, ski, or do about anything else involving transportation. You probably had somebody help you learn. You started in a safe location. You started slowly. All these techniques apply to the SMART BRAKE products.

If you carefully follow all the instructions and warnings in the User Manual, and supplementary Safety Video, you should be able to teach yourself how to use the SMART BRAKE products. We strongly recommend to get support from a more experienced user in the beginning.

Prior to each trip, ensure the tires are well maintained, battery fully charged, and there are no loose components.

Please do not take risks.

WARNING!

Never attempt to use a SMART BRAKE product without the SMART BRAKE properly installed, charged and updated. Using your SMART BRAKE products without all parts properly installed could damage your SMART BRAKE products and result in serious injury from loss of control, collisions, and falls.

Do not modify the SMART BRAKE products. Modifications to the SMART BRAKE products without the prior written approval of SmartGroup could interfere with the operations of the SMART BRAKE products, could result in serious injury and/or damage, and could void the SMART BRAKE Limited Warranty.

SMART BRAKE - Limited Warranty

SmartGroup AS, Osloveien 35, 1534 Moss, Norway (“SmartGroup”) provides this limited warranty to original purchasers (and transferees, as provided below) of new RollerSafe SMART BRAKE (“SMART BRAKE”), separately purchased SmartGroup authorized parts, Accessories, and Service Repair purchased in and situated in Norway, the United States or other markets outside Norway. The term, “original purchaser”, as used herein, means the first retail purchaser who acquires the new and certified used SMART BRAKE, separately purchased SmartGroup authorized parts, or Accessory from SmartGroup or a SmartGroup Authorized Dealer. The term, purchaser”, as used herein, refers to the original purchaser and to any person who acquires the SMART BRAKE, separately purchased SmartGroup authorized parts, Accessories, and Service Repair during the period of limited warranty coverage and so notifies SmartGroup of the SMART BRAKE purchase within ten days of acquiring the SMART BRAKE. Subject to the exclusions, limitations and conditions stated below, for a new SMART BRAKE, SmartGroup warrants the SMART BRAKE Remote Controller, the batteries and the foregoing separately purchased parts against defects in materials and workmanship for a period of one (1) year from date of delivery to the original purchaser.

Subject to the exclusions, limitations and conditions stated below, SmartGroup guarantees the SMART BRAKE Remote Controller Batteries against defects in materials and workmanship for a period of one hundred eighty (180) days from date of delivery to the original purchaser. Subject to the exclusions, limitations and conditions stated below, SmartGroup warrants all other components of the new and certified used SMART BRAKE against defects in materials and workmanship for a period of ninety (90) days from date of delivery to the original purchaser.

“Accessory” means a product sold by SmartGroup for use with a SMART BRAKE. “Service Repair” means any repair performed by SmartGroup on a SMART BRAKE or component part. SmartGroup shall solely determine whether the cause of any failure is a component part or a Service Repair. SmartGroup shall, within a reasonable period of time perform Service Repair subject to the exclusions, limitations, and conditions stated below.

Subject to the exclusions, limitations and conditions stated below, any component part replaced during the applicable warranty period will qualify for repair and replacement for the balance of the original applicable warranty. During the applicable limited warranty period, SmartGroup shall, within a reasonable period of time, repair or replace, at its choice, (with new or reconditioned parts of the same or similar style and with upgraded software, if appropriate) the defective component of the SMART BRAKE or Accessory subject to the exclusions, limitations, and conditions stated below. SmartGroup may choose to simultaneously replace non-defective parts that are part of a sub-assembly that contains the defective component. Any replaced components, parts or accessories (defective parts and parts that are part of such a sub-assembly) will become the property of SmartGroup. This Limited Warranty does not cover damage to a SMART BRAKE, component part, or Accessory caused by any of the following: all external causes such as (without limitation) dropping, accident, collision, fire, immersion in water, freezing, or striking objects; misuse such as riding over obstacles, over loading, racing, or otherwise using the SMART BRAKE, component part, or Accessory contrary to the instructions and warnings contained in the User Manuals issued by SmartGroup (the “User Manuals”); altering or modifying the SMART BRAKE, component part, or Accessory; loosening or opening the Control Box of the SMART BRAKE or otherwise accessing the components within the SMART BRAKE (Controller Boards, Motors, Pumps, and internal wiring) without authority from SmartGroup; deterioration of paint, trim, and appearance items that results from use and/or exposure to the elements; cleaning with a high-pressure water system, abrasives, or solvents; exposure to environmental conditions beyond the limits stated in the User Manuals; failure to properly maintain or improperly servicing the SMART BRAKE, component part, or Accessory; damage caused by use of non-SmartGroup parts or attachments; improper charging of the SMART BRAKE; or shipping of the SMART BRAKE in boxes other than those recommended by SmartGroup. See the User Manuals for proper use, maintenance, and charging of a SMART BRAKE, component part, or Accessory.

To obtain repair or replacement under this Warranty, contact an Authorized SmartGroup Dealer within the applicable limited warranty period. Find the closest Authorized SmartGroup Dealer on www.mysmartbrake.com. If you are unable to contact your local Authorized SmartGroup Dealer you may contact SmartGroup at post@smartgroup.no.

When contacting the Authorized SmartGroup Dealer be prepared to describe the problem as well as provide proof of purchase, proof of date of delivery to the original purchaser, and serial number of the SMART BRAKE. If the purchaser is unable to resolve the problem with the assistance of the Authorized SmartGroup Dealer, and if this Limited Warranty applies, the Authorized SmartGroup Dealer will contact SmartGroup’s Service Center to determine the procedure to be followed to repair or replace the SMART BRAKE, defective component, or Accessory, which may include, at SmartGroup’s election: SmartGroup may provide purchaser with a Return Materials Authorization number (“RMA#”). Purchaser shall then deliver the SMART BRAKE, defective component, or Accessory to SmartGroup or SmartGroup’s Authorized Dealer or other service provider, (as instructed by SmartGroup), properly packaged (so as to prevent damage during shipment) and with the RMA# written on the outside of the packaging. Because of shipping restrictions, SmartGroup may require that purchaser, in order to obtain warranty service on a Lithium-ion battery, ship to SmartGroupSmartGroup’s Authorized Dealer, or other service provider the SMART BRAKE with the Lithium-ion battery pack installed on the SMART BRAKE. If the returned SMART BRAKE, component part or Accessory is defective and this Limited Warranty applies, SmartGroup (or SmartGroup‘s Authorized Dealer or other service provider) shall, within a reasonable period of time, repair the SMART BRAKE, or repair or replace the defective component, or Accessory. Purchaser shall then pick up the repaired SMART BRAKE or repaired or new or reconditioned component, or Accessory from SmartGroup or SmartGroup’s Authorized Dealer or other service provider. Purchaser shall pay the cost of shipping to SmartGroup or Authorized Dealer or other service provider and purchaser shall bear the risk of loss during shipping for any SMART BRAKE, defective component, or Accessory for which purchaser claims this Limited Warranty applies. If this Limited Warranty applies, SmartGroup shall be responsible for paying the cost of shipping to the Authorized Dealer or other service provider or purchaser when returning the SMART BRAKE, replacement part, or Accessory. SmartGroup’s obligations and liability for any defects in any SMART BRAKE, component part, or Accessory are limited to repair or replacement of defective parts as required by this Limited Warranty. SmartGroup neither assumes (nor authorizes anyone to assume for it) any other obligation or liability in connection with a SMART BRAKE, component part, Accessory, Service Repair, or this Limited Warranty. SmartGroup is not responsible for any loss of use of a SMART BRAKE, component part, or Accessory or for any inconvenience or other loss or damage which might be caused from any defect in a SMART BRAKE, component part, Accessory, or Service Repair or for any other incidental or consequential damages the Purchaser may have as a result of any defect in a SMART BRAKE, component part, Accessory, or Service Repair.

THIS LIMITED WARRANTY IS THE ONLY WARRANTY APPLICABLE TO SMART BRAKE, COMPONENT PARTS, ACCESSORIES, AND SERVICE REPAIR. SMARTGROUP DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER APPLICABLE LAW. ANY SUCH IMPLIED WARRANTIES WHICH MAY BE REQUIRED BY LAW AND ARE NOT DISCLAIMED HEREBY ARE LIMITED, TO THE EXTENT ALLOWED BY LAW, TO THE APPLICABLE PERIOD OF THIS LIMITED WARRANTY, OR TO THE APPLICABLE TIME PERIOD PROVIDED BY THE APPLICABLE STATE LAW, WHICHEVER PERIOD IS SHORTER. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO SOME PURCHASERS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO SOME PURCHASERS.

ONE YEAR LIMITED WARRANTY – SMART BRAKE

This document covers SmartGroup’s one year limited warranty for SMART BRAKE

SmartGroup AS warrants this product to be free from defects in materials and workmanship for a period of (1) year from the original date of purchase at retail. It will be repaired, or replaced if, upon inspection at an authorized SmartGroup Service Center and sent to and agreed upon by a SmartGroup Warranty Service Technician, it is found to be defective in materials or workmanship.

This warranty does not apply to damage resulting from accidents, abuse, negligence, impact (striking a curb, rail, road hazards, etc), repairs or alterations outside of our authorized SmartGroup Service Center, improper mounting of frames, wheels, or hardware, or mounting with other than SmartGroup products, and is subject to the following terms and limitations:

Purchasers responsibilities

1)The Purchaser must retain a copy of the Original Proof of Purchase from the Dealer.

2)Damaged product submitted for warranty service must be taken, along with the Original Proof of Purchase, to the SmartGroup Dealer before expiration of the (1) year warranty period.

SmartGroup’s Responsibilities

(1). Products returned for warranty service shall be inspected by a SmartGroup Warranty Service Technician.

(2). If the problem is judged by SmartGroup to be due to a factory defect, we will repair, or replace (with an identical or reasonably equivalent product) the product at our election, or we may choose to refund the purchase price (less reasonable depreciation based on actual use) if we cannot readily and quickly provide a replacement.

(3). SmartGroup will return the repaired or replacement product at our expense, but if we determine that there is no defect or that the defect resulted from causes not within the scope of this warranty, storage and or return of the product will be at the customers expense.

(4). The SmartGroup Warranty Manager makes the final determination concerning defects in materials and workmanship.

SmartGroup’s Responsibilities

Limitations:

(1). SmartGroup limits all implied warranties (including, but not limited to fitness and merchantability) to one (1) year from the original date of purchase at retail. In the event that the purchaser is unable to provide proof of purchase, it will be at the discretion of the Warranty Service Technician as to weather it will be warrantable.

(2). This warranty extends only to the original retail purchaser, and is not transferable.

(3). SmartGroup’s sole liability from this warranty is limited to repair and replacement of defective product. Under no circumstances shall SmartGroup be held liable for death or injuries to persons, damage to property, or for incidental, contingent or consequential damages or expenses arising from the use of SmartGroup products.

(4). Replacement products under this warranty are warrantied only for the remainder of the original warranty period.

Dealers Responsibilities

(1). Request a copy of the original Proof of Purchase and determine if the product is still under warranty.

(2). Inspect the product to try and make a determination of the defect.

(3). Contact a SmartGroup Customer Service Representative and be prepared to give the following information:

  (a). Account number.     (f). Product model and size.  

  (b). City     (g). Original Purchase Date.  

  (c). New or used product.     (h). Serial number.  

  (d). Consumers name (Last, First).     (i). Point of contact phone number.  

  (e). Dealer reference number.     (j).Defect description.  

(4). Remove any post applied devices from product.

(5). Send the product, packaged securely with the following information:

  (a). RMA number received from SmartGroup Customer Service Rep. written on outside of package.

  (b). RMA number and Copy of Original Proof of Purchase must be included inside of package.

(c). Send package to:

(6). The purchaser and or the dealer is responsible for shipping and handling charges to the SmartGroup Service Center along with non warrantable product back from the SmartGroup Service Center.
